Deferred Prosecution


The Coconino County Adult Probation Department supervises a category of non-convicted clients called Deferred Prosecution. This program differs from supervised probation as the clients have not plead guilty to their offense, and the offense will be dismissed after the successful completion of basic terms over a short time period. Clients are typically offered Deferred Prosecution for a 3 or 6 month period for cases in which the individual is without other criminal history and meets other requirements as defined by the County Attorney's Office.

Clients are typically asked to pay a fee equivalent to $75 per month of Deferred Prosecution, complete a basic education program as related to their offense, and remain law abiding for the length of their deferred contract. This program is primarily made up of first time offenders and successful completion of this program will allow the client to avoid a criminal conviction on their record. The high success rate of the Deferred Prosecution Program indicates that this resource assists with correcting behavior while allowing low risk offenders to avoid a criminal conviction.
