The deferred prosecution program provides a meaningful alternative to prosecution for first time offenders who have committed relatively minor offenses.
Who Can Participate
The program is designed for those who are remorseful and willing and able to pay restitution and supervision costs. The deferred prosecution program is available at the discretion of the County Attorney. Defendants do not have a right or entitlement to the program.
In Case of Failure
A defendant’s failure in the program will result in reinstatement of prosecution.
